Scope of Terms

These Terms govern your use of Habita's services (“Service”). By using the Service, you agree to these Terms.

Service Provision

  1. Habita provides access to the aggregated listings to assess user engagement and features.
  2. Habita reserves the right to modify or discontinue the Service at any time without prior notice.

Registration and Access

  1. Registration may be required to access certain features. Users must provide accurate information.
  2. Users are responsible for keeping login credentials secure.

Payments and Fees

  1. All payments, fees, refunds, and cancellations are governed by our Fees, Payments, and Cancellation Supplemental Terms, which are incorporated by reference into this agreement.
  2. Payment processing services for renters and payout services for Scouts on Habita are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service. By booking a visit or receiving a payout, you agree to be bound by the Stripe terms.

User Obligations

  1. Do not misuse the Service (e.g., engage in illegal activities or violate third-party rights).
  2. Do not copy, distribute, or modify the Service's content without authorisation.
  3. For Scouts: You must keep all renter information strictly confidential, safe, and secure, and use such information solely for the purpose of completing a booked visit.

Intellectual Property

All Service content and features are the intellectual property of Habita unless explicitly stated otherwise.

Liability

  1. The Service is provided “as-is.” Habita disclaims all warranties to the maximum extent permitted by law.
  2. Habita is not liable for damages arising from the use of our services.

Data Privacy

Data collected during usage will comply with applicable laws and our Privacy Policy. Habita will not sell your data. Your data will be shared with our content partners to enhance your use of the Habita site and services.

Scout Vetting & Trust

Habita manually reviews Scouts based on available public and internet presence to maintain a trusted community. We will utilize a third-party consumer reporting agencies for formal background checks in the near future.

Non-Discrimination & Fair Housing

Habita is committed to equal opportunity. We strictly prohibit Scouts, Renters, and any users from discriminating against anyone on the basis of race, color, religion, sex, disability, familial status, or national origin.

Governing Law & Dispute Resolution

  1. Governing Law: These Terms and any disputes arising out of them will be governed by the laws of the State of California, without regard to its conflict of laws principles.
  2. Arbitration & Class-Action Waiver: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration administered in California. You and Habita agree to waive the right to a trial by jury or to participate in a class action.
